Senior Attorney

The Third Party Division is responsible for collecting funds due NYSIF when a third party matter settles or there is a verdict after trial. The Senior Attorney duties and responsibilities will consist of but not limited to:
- reviewing e-mail, mail and answering calls from plaintiff's counsel, insurance agencies, safety groups, NYSIF employees and other stakeholders regarding new or pending third party actions; - assert and calculate liens and issuing written consent pursuant to WCL section 29 for settlement. - reviewing legal matters and calculating appropriate lien totals considering disbursement, burns payments and holidays from payments; - negotiating settlement of liens in NYSIF's best interest; - following with plaintiff's counsel for lien reimbursement to the fullest extent allowed by law and to the benefit of NYSIF. Upon receipt of funds, the senior attorney will advise cash management of appropriate crediting to the file. - updating Claims Center, FileMaker Pro and other databases as needed, - responding to internal and external e-mails regarding the current status of matters. - where necessary, draft motion, briefs, memorandum of law and appear in Court to defend the carrier's position relative to its lien; share of attorney's fees and right to credit. - respond to inquiries from claims staff on third party status, application of third-party credit and section 32 approvals and consult with legal appeals team to assist in defending NYSIF's third party positions at the WCB and state courts. - serving as a mentor to NYSIF staff including legal assistants and legal support staff.

Salary Range:
From $88161 to $111111 Annually
Minimum Qualification
Reachable on current Civil Service eligible list used for filling this title; or, one year of permanent, competitive class service as a Senior Attorney; or, one year of permanent, competitive service in a title eligible for transfer under Section 70.1 or 52.6 of the Civil Service Law. Example of eligible titles include but are not limited to:
Senior Attorney Realty. 52.6 transfers may be considered only if you have passed the NYS Bar Exam.Estimated Salary: $20 to $28 per hour based on qualifications.

Don't Be Fooled

The fraudster will send a check to the victim who has accepted a job. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
